Distance Sales Agreement and Pre-Contract Information

This agreement is drawn up under Law No. 6502 on Consumer Protection and the Distance Contracts Regulation. The pre-contract information form in Part A is provided to you before you place your order. The distance sales agreement in Part B is concluded when you confirm your order at checkout. The Turkish version is binding.
PART A: PRE-CONTRACT INFORMATION FORM

A.2 Importer and brand owner

A.3 Goods
The type, quantity, main characteristics and unit price of the goods are shown on the product page and in the order summary at checkout. All ANAAKA products are cosmetics made in Italy and registered in the Product Tracking System (ÜTS) of the Turkish Medicines and Medical Devices Agency (TİTCK).
A.4 Price and payment
All prices are in Turkish lira and include VAT. Delivery is free. The total amount payable is shown in the order summary before you confirm the order. Payment is made by credit or debit card, in a single payment or in instalments where offered by your bank, through the licensed payment institution iyzico.
A.5 Delivery
Goods are delivered to the address you enter at checkout: within 48 to 72 hours in Istanbul and within up to 5 business days elsewhere in Turkey, and in any case within 30 days of the order at the latest. Delivery is carried out by the Seller's logistics partner Servex and cargo companies. Details: Delivery Policy.
A.6 Right of withdrawal
You may withdraw from the contract within 14 days of delivery without giving any reason and without paying any penalty, by notifying the Seller at support@anaaka.com. Under article 15/1-ç of the Distance Contracts Regulation, the right of withdrawal does not apply to cosmetics whose protective wrap, seal or packaging has been opened after delivery, as they are unsuitable for return for health and hygiene reasons. Return shipping is free: the Seller arranges a courier pickup from your address. The Seller refunds the full amount within 14 days of receiving your withdrawal notice. A.7 Complaints and disputes
You can send complaints to support@anaaka.com. For disputes, you may apply to the Consumer Arbitration Committee or the Consumer Court at your place of residence or where the transaction took place, within the monetary limits announced each year by the Ministry of Trade.
PART B: DISTANCE SALES AGREEMENT
Article 1: Parties
Seller: Kerem Şahan (ANAAKA Türkiye), details as in A.1.
Buyer: the person who places the order on anaaka.com.tr, with the name, address, email and phone number entered at checkout.
Article 2: Subject
This agreement sets out the rights and obligations of the parties regarding the sale and delivery of the goods ordered by the Buyer on anaaka.com.tr, under Law No. 6502 and the Distance Contracts Regulation.
Article 3: Goods, price and payment
The goods, quantity, unit and total price including VAT, delivery cost (free) and payment method are as shown in the order summary and the order confirmation email, which form an integral part of this agreement. In instalment payments, the terms of the Buyer's card-issuing bank apply.
Article 4: Delivery
4.1 The goods are delivered to the Buyer or a person at the address designated by the Buyer, within the periods stated in A.5 and within 30 days at the latest.
4.2 The Buyer should inspect the parcel on delivery. If the parcel is damaged, the Buyer should have a damage report drawn up by the courier and notify the Seller within 48 hours.
4.3 If the Seller cannot deliver the goods, it informs the Buyer before the delivery period expires and refunds all payments within 14 days at the latest.
Article 5: Right of withdrawal
5.1 The Buyer may withdraw from this agreement within 14 days of delivery without giving any reason and without paying any penalty. The period starts on the day the goods are delivered to the Buyer or a third party designated by the Buyer; for orders delivered in parts, on the delivery of the last item.
5.2 Notice of withdrawal is given by email to support@anaaka.com or in writing to the Seller's address. The sample withdrawal form on the Return and Withdrawal Policy page may be used.
5.3 The Seller arranges collection of the goods from the Buyer's address free of charge. The Buyer returns the goods, together with any free gifts, in their original packaging with the protective wrap unopened.
5.4 The Seller refunds the full amount paid, using the same payment method, within 14 days of receiving the withdrawal notice, at no cost to the Buyer. The time the bank takes to credit the card is outside the Seller's control.
5.5 Exception: under article 15/1-ç of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for goods whose protective wrap, tape, seal or packaging has been opened after delivery and which are unsuitable for return for health and hygiene reasons. ANAAKA products are cosmetics and fall under this exception once opened.
Article 6: Defective goods
If the goods are defective, damaged or different from those ordered, the Buyer may use the rights under Law No. 6502: withdrawal from the contract, a price reduction, free repair or replacement. The Seller covers all costs. The Buyer should notify the Seller at support@anaaka.com with photographs.
Article 7: Personal data
The Buyer's personal data is processed under Law No. 6698 as described in the Privacy Policy and KVKK Notice.
Article 8: Disputes
For disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence or where the transaction took place are competent, within the monetary limits announced each year by the Ministry of Trade.
Article 9: Entry into force
By confirming the order at checkout, the Buyer declares that they have read the pre-contract information and this agreement and accept them electronically. The agreement enters into force when the order is confirmed. A copy is sent with the order confirmation email and remains available on this page.
